Time flies. Twenty-one years ago, on February 10, 1995, a dozen NGOs decided in New York to form a Coalition for the International Criminal Court (CICC). They were 25. The idea quickly spread like wildfire. At that time, activism was in vogue. The concept of “civil society” was beginning to take root. Impunity was decried.
The Center for Information and Studies on Rwanda (CIER) became the 33rd member of this coalition that would change the face of international justice. I’m talking about CIER because, at that time, I was the Executive Director of this association, which brought together the best lawyers in the African Great Lakes region, including Professor Charles Ntampaka, the former President of FIDH, and former Rwandan post-genocide prosecutor, François Nsanzuwera, or former ICRC official in Guatemala, Belgian Colonel Raymond François des Touches.
When Nsazuwera, who chaired the CIER, came to ask me to put our association on the CICC list, he was convinced that a permanent international criminal court was the only way to fight against impunity in the world. Today, the CICC has more than 1,000 member associations in more than 150 countries around the world. I believed in it, and I am proud of CIER’s modest contribution to the establishment of the ICC.
The ICC: a way to fight against impunity
Unfortunately, the ICC is badly perceived, especially by African countries.
Some countries, which have ratified the Rome Statute, as well as those who have not joined, believe that the Court has become “an instrument of oppression” against the leaders of the black continent.
They consider that justice has no borders, and cite as an example the war on terror unleashed in Iraq in 2003 just a year after the creation of the ICC, which killed nearly 1.3 million people. No investigation has been opened into war crimes and crimes against humanity committed in that country.
Kenya has threatened to review its collaboration with the ICC, without excluding the possibility of leaving. Two top leaders of the country, President Uhuru Kenyatta and Vice President William Ruto were tried in The Hague. In September 2013, the Kenyan Parliament adopted the motion allowing the country to withdraw from the International Criminal Court (ICC).
But it was not until April 2016 that two bills relating to Kenya’s withdrawal from the ICC were submitted to MPs. According to article 127 of the Rome Statute, the withdrawal does not affect the continuation of the examination of cases before the Court before the date on which it took effect.
Withdrawal does not affect the duty to cooperate with the ICC …
Burundi has just followed suit in Kenya. Parliament voted in favor of the withdrawal of the ICC. The text was quickly voted by the Senate before being promulgated by President Pierre Nkurunziza.
After Burundi, South Africa was withdrawn from the ICC, followed a few days later by The Gambia.
Other African countries could announce their withdrawal in the coming months.
But beware, always according to Article 127, the withdrawal does not affect the cooperation established with the Court in criminal investigations and proceedings in respect of which the State had the duty to co-operate before the date on which the withdrawal took effect.
Since November 2015, Namibia is also planning to leave the ICC. In February 2016, at the suggestion of Kenyan President Uhuru Kenyatta, the African Union adopted a text providing for the withdrawal of African countries from the ICC.
Withdrawal by a State Party or a group of States Parties, such as those grouped within the AU, is done by “written notification to the Secretary-General of the United Nations. The withdrawal shall take effect one year after the date on which the notification was received.
